Terms of Service

1. Acceptance of Terms

By accessing socialdada.com or engaging our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our services.

These terms apply to all users of our platform including clients, professionals, and visitors.

2. Services Provided

SocialDada provides:

• Custom website design and development
• E-commerce, portal, and mobile app development
• SEO, digital marketing, and AI automation services
• A marketplace to connect clients with vetted web professionals
• Domain marketplace — buying and selling of domain names
• Hosting, security, and maintenance services

3. Payment Terms

• Booking Deposit (10%): Due upon project confirmation. Secures your build slot.
• Site Delivery (40%): Due when the completed website is delivered to staging for your review.
• 30-Day Balance (50%): Due 30 days after the site goes live.
• All prices are in USD unless otherwise stated.
• Final pricing is confirmed in your written proposal before any payment is due.
• Coupon codes, where applicable, apply to the project total and are valid for single use only.
• The 10% booking deposit is non-refundable if the client cancels after work has commenced.

4. Project Delivery & Revisions

• Timelines quoted in proposals are estimates based on scope provided.
• Unlimited revisions are included within the agreed scope.
• Changes to scope after project commencement may incur additional charges.
• Rush delivery is available at a surcharge as indicated in the proposal.
• The client is responsible for providing required content (text, images, logos) promptly. Delays in content provision may delay delivery.

5. Intellectual Property

Upon receipt of final payment, the client owns all custom design and code created specifically for their project. SocialDada retains the right to display the completed work in its portfolio unless the client requests otherwise in writing.

Third-party themes, plugins, fonts, or stock images remain subject to their respective licenses. SocialDada will notify clients of any third-party licensing costs.

6. Domain Marketplace

• A non-refundable $10 listing fee applies to each domain listed for sale.
• Domain transactions are between buyer and seller directly. SocialDada is not a party to the sale.
• SocialDada makes no guarantees regarding the value, availability, or transferability of listed domains.
• Sellers are responsible for the accuracy of all listing information.
• SocialDada reserves the right to remove listings that violate these terms or contain false information.

7. Professional Marketplace

• Professionals listed on SocialDada are independent contractors, not employees of SocialDada.
• SocialDada vets all professionals but does not guarantee outcomes of engagements arranged directly between parties.
• For projects managed by SocialDada directly, our service guarantee applies.

8. Limitation of Liability

To the maximum extent permitted by law, SocialDada's total liability for any claim arising out of or relating to these terms or our services shall not exceed the amount paid by the client for the specific service giving rise to the claim in the six months prior to the claim.

SocialDada is not liable for indirect, incidental, or consequential damages including but not limited to loss of revenue, data, or business opportunities.

9. Termination

Either party may terminate the agreement with 7 days written notice. Upon termination, all completed work remains the intellectual property of SocialDada until outstanding payments are settled. The client retains rights to all work paid for to date.

10. Governing Law

For US-based clients, these terms are governed by the laws of the State of New Jersey. For India-based clients, these terms are governed by the laws of the Republic of India, with jurisdiction in Noida, Uttar Pradesh. For international clients, the laws of New Jersey apply by default.

11. Changes to Terms

We reserve the right to update these terms at any time. The most current version will always be posted at socialdada.com/terms. Continued use of our services after changes constitutes your acceptance of the revised terms.
